Ban on Surrender of certain CERs - Registering forward contracts
You must register any forward contracts for banned certified emission reduction units (CERs) by 10 February 2012. Regulations have been passed banning the surrender of specific CERs in the NZ ETS. These regulations can be accessed here.
Any banned CERs which enter the New Zealand Emission Unit Register after 24 December 2011 will not be eligible for surrender by account holders unless they were:
purchased under a forward contract executed prior to 23 December 2011; and
registered with the Registrar by 10 February 2012.
To register a contract you need to provide a copy of the contract and a statutory declaration to the Environmental Protection Authority (EPA). A copy of the contract and the accompanying statutory declaration can be posted or emailed to the Registrar by either:
posting them to The Registrar, ETS Division, Environmental Protection Authority, Private Bag 63002, Waterloo Quay, Wellington 6140; or
Scanning and emailing them to climatechange@epa.govt.nz.
A statutory declaration template is available here. Account holders may blank out the price of any units in the contract prior to sending it to us if they consider it to be commercial information.
Banned CER’s can be identified using the Project ID’s of the projects they were created under. The Ministry for the Environment will provide a list of the known banned units as at January 2011 on their website, and more information on the process for identifying them will shortly be available at www.climatechange.govt.nz/ets.
